Please read these terms carefully before using NDISNotes

1. Acceptance of Terms

By accessing or using NDISNotes, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. We may update these terms from time to time, and continued use constitutes acceptance of changes.

2. Description of Service

NDISNotes is a cloud-based documentation platform designed for NDIS support workers to create, manage, and share progress notes, incident reports, and related documentation. The service includes AI-assisted note writing, PDF generation, and email delivery features.

3. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials. You must not share your login details with other individuals. You agree to notify us immediately of any unauthorised use of your account. NDISNotes reserves the right to suspend or terminate accounts that violate these terms.

4. Subscription Plans and Billing

NDISNotes offers a permanent Free plan and three paid subscription tiers: Starter, Pro, and Business. The Free plan is available without a payment method and includes 3 progress notes and 3 incident reports per month, with usage counters resetting on the 1st of each month. Paid plans are charged immediately on signup via Stripe — no free trial is offered. Monthly and annual billing is processed via Stripe. Business plan pricing is quote-based and billed separately. Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date.

5. No-Refund Policy

Once you start a paid plan (Starter, Pro, or Business), all fees are non-refundable. This applies to monthly and annual subscriptions, prorated upgrade charges, and renewal charges. You may cancel at any time from the Billing page to prevent future renewals — your access continues until the end of the period you have already paid for, after which the subscription will not renew and your account will revert to the Free plan. We do not offer refunds for unused time, partial months, downgrades, accidental renewals, or cancellation after a paid period has started. This policy does not affect any non-excludable rights you may have under the Australian Consumer Law.

6. Acceptable Use Policy

• You must not store false or fabricated participant information
• You must hold appropriate NDIS worker clearances and screening checks
• You must comply with the NDIS Practice Standards when using the platform
• You must not share your login credentials with unauthorised users
• You must not use the service for any unlawful purpose

7. Intellectual Property

All content, design, and software comprising NDISNotes is owned by NDISNotes. Documentation created by users remains the intellectual property of the user or their employing organisation. You grant NDISNotes a limited licence to process your content solely for the purpose of providing the service.

8. Limitation of Liability

NDISNotes provides a documentation assistance tool and does not guarantee compliance with NDIS standards. Users are responsible for reviewing all AI-generated content for accuracy. NDISNotes is not liable for any losses arising from the use of AI-generated documentation without review. To the maximum extent permitted by law, our liability is limited to the fees paid for the service in the preceding 12 months.

9. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect.

11. Data Processing and Account Deletion

NDISNotes stores participant data on behalf of the support worker or provider (the data controller). NDISNotes is a data processor under the Australian Privacy Act 1988. Users are responsible for ensuring they comply with their own obligations under the NDIS Act regarding retention of participant records before deleting their NDISNotes account.
